We are Twenty, Inc., d/b/a Hello World (“Hello World”, “we”, “our” or “us”) a Californian not-for-profit company with registered address at 19201 Sonoma Hwy #275 Sonoma, CA 95476.
These terms of use (“Terms of Use”) are entered into by and between you and Hello World and govern your access to and use of the helloworldnetwork.org websites (the “Websites”) and our mobile applications (the “Mobile Apps”) (together, the “Services”). These terms are separate and independent of the terms and conditions provided by third party charities, foundations, groups and other organizations ("Organizations") who provide opportunities.
The Services are aimed at users aged 13 and older. You will not: (a) select or use as a Hello World User ID a name of another person with the intent to impersonate that person; (b) use as a Hello World User ID name which is subject to any rights of a person other than you without appropriate authorization; or (c) use as a Hello World User ID name that is otherwise offensive, vulgar or obscene.
Hello World reserves the right to refuse registration of, or cancel a Hello World User ID in its sole discretion. You are solely responsible for activity that occurs on your Account (except where any unauthorized use is our fault) and you are responsible for maintaining the confidentiality of your Hello World password. You will never use another user’s account without such other user’s express permission. You will notify Hello World in writing at legal@gethello.org as soon as you can of any unauthorized use of your Account, or other account related security breach of which you are aware.
By creating an Account, you agree that we may communicate with you (through our Websites, Mobile Apps or the contact information you provided), and send you information as part of the Services regarding your requests for information technical notices, security alerts, support and administrative messages, significant updates to the Services or our policies.

Hello World is an education service, not an outlet for obtaining emergency services. You agree that the Services are not intended to support or carry emergency or time-critical calls or communications to any type of hospital, law enforcement agency, medical care unit or any other kind of emergency or time-critical service (“Emergency Services”). By agreeing to these Terms of Use you acknowledge that additional arrangements must be made to access Emergency Services. You recognize and agree that Hello World is not required to offer Emergency Services or access thereto pursuant to any applicable local and or national rules, regulation or law. You further acknowledge that Hello World is not a replacement for your primary telephone service or any other means of communication.
Nothing in these Terms of Use will exclude or limit: (a) any person's liability for death or personal injury caused by negligence; (b) liability for fraud; or (c) any liability which cannot be limited or excluded by law. Nothing in these Terms of Use is intended to affect your legal rights as a consumer.
Hello World will not be liable to you for any losses or damages suffered by you that: (a) were not reasonably foreseeable by you and us at the time you accepted these Terms of Use - loss or damage is reasonably foreseeable if either it is obvious at the time you accepted these Terms of Use that it may happen or, both you and we knew it might happen, for example, if you and we discussed it; or (b) are not caused by us breaking a term of these Terms of Use, or any other failure by us; and (c) businesses losses and/or losses to non-consumers.
You acknowledge that the Services cannot be guaranteed to be error free and further acknowledge that the existence of any such errors will not constitute a breach of these Terms of Use. Hello World does not guarantee any specific results from the use of the Services. Although Hello World takes reasonable precautions to prevent the existence of computer viruses and/or other malicious programs in the Services, we cannot guarantee that there will not be any.
These Terms of Use, their subject matter and its formation, are governed by English law. However, if you are a consumer and resident of any European Union country you will benefit from mandatory provisions of, and legal rights available to you under, the laws of that country. Nothing in these Terms of Use affects your rights as a consumer to rely on these local law mandatory provisions and legal rights.
You and we both agree that the courts of England and Wales will have exclusive jurisdiction, except, if you are a consumer and resident of any other country you and we may also bring proceedings in that country.

You agree to defend, indemnify, and hold harmless Hello World and its affiliates, and each of its and its affiliates’ employees, contractors, agents, officers, directors, suppliers and representatives, from and against any and all claims, damages, judgments, awards, obligations, losses, liabilities, costs or debt, and expenses or fees (including but not limited to attorney’s fees), resulting from or arising out of (i) your use or misuse of, or access to, the Services or otherwise from your User Submissions, (ii) your violation of the Terms of Use, or (iii) infringement by you, or any third party using your account, of any intellectual property or other right of any person or entity. Hello World reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will assist and cooperate with Hello World in asserting any available defenses.
All matters relating to the Services or these Terms of Use and any dispute or claim arising therefrom or related thereto shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision or rule (whether of the State of California or any other jurisdiction).
Any legal suit, action or proceeding arising out of or related to the Services or these Terms of Use that is not subject to arbitration as set forth in these Terms of Use below shall be instituted exclusively in the federal courts of the United States or the courts of the State of California, in each case located in the County of Sonoma or the County of San Francisco, although we retain the right to bring any suit, action or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
This Section includes an arbitration agreement and an agreement that all claims will be brought only in an individual capacity (and not as a class action or other representative proceeding). Please read it carefully. You may opt out of the arbitration agreement by following the opt out procedure described below.
Informal Process. You agree that in the event of any dispute between you and Hello World, you will first contact Hello World and make a good faith sustained effort to resolve the dispute before resorting to more formal means of resolution, including without limitation any court action.
Agreement to Arbitrate. After the informal dispute resolution process, any remaining dispute, controversy, or claim (collectively, “Claim”) relating in any way to these Terms of Use or Hello World’s services and/or products, including but not limited to the Services, or relating in any way to the communications between you and Hello World or any other user of the Services, will be finally resolved by binding arbitration. This mandatory arbitration agreement applies to you and to Hello World. However, this arbitration agreement does not (a) govern any Claim by Hello World for infringement of its intellectual property or access to the Services that is unauthorized or exceeds authorization granted in these Terms of Use or (b) bar you from making use of applicable small claims court procedures in appropriate cases. You may opt out of this arbitration agreement within thirty (30) days of the first of the date you access or use this Services by following the procedure described below.
You agree that the U.S. Federal Arbitration Act governs the interpretation and enforcement of this provision, and that you and Hello World are each waiving the right to a trial by jury or to participate in a class action. This arbitration provision will survive any termination of these Terms of Use.

The arbitration will be administered by the American Arbitration Association (AAA) under its rules including, the AAA's Supplementary Procedures for Consumer-Related Disputes. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules. Hello World will reimburse those fees for claims where the amount in dispute is less than $10,000, unless the arbitrator determines the claims are frivolous, and we will not seek attorneys’ fees and costs in arbitration unless the arbitrator determines the claims are frivolous.
The arbitrator, and not any federal, state, or local court, will have exclusive authority to resolve any dispute relating to the interpretation, applicability, unconscionability, arbitrability, enforceability, or formation of this arbitration agreement, including any claim that all or any part of this arbitration agreement is void or voidable. However, the preceding sentence will not apply to the “Class Action Waiver” section below.
If you do not want to arbitrate disputes with Hello World, you may opt out of this arbitration agreement by sending an email to legal@gethello.org within thirty (30) days of the first of the date you access or use the Services.
Class Action Waiver. Any Claim must be brought in the respective party’s individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, multiple plaintiff, or similar proceeding (“Class Action”). The parties expressly waive any ability to maintain any Class Action in any forum. If the Claim is subject to arbitration, the arbitrator will not have authority to combine or aggregate similar claims or conduct any Class Action nor make an award to any person or entity not a party to the arbitration. Any claim that all or part of this Class Action Waiver is unenforceable, unconscionable, void, or voidable may be determined only by a court of competent jurisdiction and not by an arbitrator. The parties understand that any right to litigate in court, to have a judge or jury decide their case, or to be a party to a class or representative action, is waived, and that any claims must be decided individually, through arbitration.
If this class action waiver is found to be unenforceable, then the entirety of the Arbitration Agreement, if otherwise effective, will be null and void. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.
Waiver of Jury Trial. If for any reason a claim proceeds in court rather than in arbitration, you and Hello World each waive any right to a jury trial.
If we fail to insist that you perform any of your obligations under these Terms of Use, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
These Terms of Use and Privacy Policy constitute the sole and entire agreement between you and Hello World with respect to the Services and any other subject matter of these Terms of Use and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to such subject matter. If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

Each of the provisions of these Terms of Use operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining provisions will remain in full force and effect.
All notices under the Terms of Use will be in writing and will be deemed to have been duly given when received, if personally delivered or sent by certified or registered mail, return receipt requested; when receipt is electronically confirmed, if transmitted by facsimile or e-mail; or the day after it is sent, if sent for next day delivery by recognized overnight delivery service.

If you believe your work has been used or copied in a way that constitutes copyright infringement and such infringement is occurring on the Website or Mobile App, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing our Designated Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

b) Receipt of Proper Infringement Notification
Once a proper bona fide infringement notification has been received by the Designated Agent, it is Hello World’s policy:

If the Content Provider believes that the Content that was removed or to which access was disabled is either not infringing or the Content Provider believes that it has the right to post and use such Content, the Content Provider may send the Designated Agent a counter-notice, which must contain the following:
If a counter-notice is received by the Designated Agent, Hello World may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed Content or cease disabling it in ten business days.
If Hello World does not receive notice within ten business days that the original complaining party is seeking a court order to prevent further infringement of the Content, we may replace or cease disabling access to the material that was removed. The decision to replace or cease disabling access to any Content is at Hello World’s sole discretion.
